TERMS OF SERVICE

At Finger Lakes Picnic Company  (FLX Picnic Co.) we strive to create beautifully curated picnic settings for our guests set in the natural beauty of Seneca Lake in the New York Finger Lakes region. With that in mind, we cannot always control the variables that make our picnics so magical - the location, weather, privacy, (and other factors that we may not even know are at play, like people!) are ever-changing. We politely ask our guests to keep this in mind when booking. We also ask that you, GUEST (the person booking the service) assumes all inherent risk and responsibility for themselves and their party when booking. Please share all information with your party before arrival to ensure safety + the best experience possible. FLX Picnic Co. is not responsible for any loss, be it physical, personal, monetary or otherwise. These terms are subject to change at any time, without notice.

WEATHER: All reservations are weather permitting. In the event of a rain event, we will do all we can to accommodate a dry picnic. We request from our GUEST to provide an alternative picnic location in the event of unfavorable weather conditions. FLX Picnic Co. defines a “rain event” as being a 45% or greater chance of rain at the picnic location during the scheduled time and up to 30 minutes before or after, as determined by Weather.com. No refunds will be issued for weather-related changes. A full credit will be available if FLX Picnic Co. needs to cancel due to extreme/hazardous weather. If GUEST requests to reschedule with a low chance of rain (44% or less), no refund shall be granted.

LOCATION: The nature of a picnic is having access to public spaces and to dine al-fresco (eating in open air). The locations provided to guests are public spaces and we cannot guarantee any location as they are all first-come, first-served. We may move your picnic, at our discretion, to provide the best experience possible. We may move a picnic for any number of reasons, some of the most frequent are safety, privacy (we cannot control who will be in a public space and when,) access to shade, views among other reasons. We cannot guarantee an exact location although we will do our best. If access is not available, we will set up in another suitable location nearby. We cannot guarantee privacy. All local rules, signs, laws and other permissions apply. 

ACCESSIBILITY: The locations are generally deemed safe at time of booking but they each have their own risk and accessibility issues- please remember these are public spaces and we have no control over terrain, public use, weather, etc. Please let us know before booking if you require assistance in getting to a picnic location or if you require a specific type of equipment  (table and chairs vs pillow seating.) Please be advised that some locations may have steep inclines, steps, grass, uneven pathways, sand, rocks or other barriers. Locations are often changing due to natural processes (wind, rain, etc.) for this reason, we cannot guarantee access.

FOOD: Please be sure to let us know of any food sensitivities before booking.  We do our best to limit cross-contamination with potential allergens. 

DAMAGE TO FURNITURE + DECOR: Please only use these items in the manner which they were intended. GUEST assumes all risk that is inherent when using furniture and decor items. GUEST is financially responsible for broken, damaged or stolen items resulting from misuse, carelessness, negligence or abandonment.

PHOTOS: By asking FLX Picnic Co. to take photos, you allow us to post on our social media accounts and any promotional materials we may produce in the future. All photos are the sole property of Finger Lakes Picnic Company and will be used at our discretion. 

CANCELLATION, CREDIT + REFUND POLICY: We offer a full refund if picnic is cancelled 14 or more days out from picnic date. 13 days or closer to the picnic date are non- refundable. Picnic credits are to be used within 1 year from the date of scheduled picnic. Cancellation due to COVID-19 regulations - city, county or state shutdown: No refunds but GUEST will have a full credit to use within 1 year from the date of scheduled picnic.

COVID-19: FLX Picnic Co. takes the utmost care to protect our guests, employees and vendors from the spread of COVID-19. We follow all CDC and local guidelines for masking, social distancing, glove + sanitation practices. GUEST agrees to notify FLX Picnic Co. of any infection before attendance and limit exposure by prohibiting infected invitees and/or cancelling the picnic if necessary. Our priority is health and safety- FLX Picnic Co. will do our best to accommodate your cancellation and rescheduling as preferable to GUEST as possible.
